TERMS AND CONDITIONS

By making a booking request (“Booking Request”) for a FOOTBELLAS course (“Course”), you accept these terms and conditions ("Terms & Conditions") and sign your agreement ("Agreement") to them.

The Agreement is made between the parent/guardian ("Parent", "you" or "your") of each enrolled child ("Child”, Pupil", “Children”) and FOOTBELLAS LTD ("FOOTBELLAS", "we", "our", "us") and is valid at all times whilst the Child is enrolled on any FOOTBELLAS course and until such time as written notice is given in accordance with these Terms & Conditions.

1.     INTRODUCTION

1.1  These Terms & Conditions apply to all FOOTBELLAS courses and holiday camps.

1.2  For enrollment of a Child in a FOOTBELLAS Course, all Parents are required to consent to these Terms & Conditions. By making a Booking Request, you accept these Terms & Conditions. We may update these Terms & Conditions from time to time.

1.3  FOOTBELLAS refers to the company with whom you have entered into this agreement.

1.4  A "Course" refers to a one-off Course of Sessions offering coaching in football. At the time of making a Booking Request, the number of Sessions included within the Course, the frequency of the Sessions and duration of the Sessions will be detailed.

1.5  A “Session” refers to the individual sessions within a Course. At the time of making a Booking Request, the number of Sessions included within the Course, the frequency of the Sessions and duration of the Sessions will be detailed.

1.6  "Holiday Camp'' refers to camps (including online activities) run by FOOTBELLAS during some school holidays.

1.7  “Football Coach” refers to the person who runs the Sessions

1.8  "Child" refers to the child attending the course, whose details are specified by the Parent on the Booking Request Form

1.9  “Booking Request” refers to the Parent requesting that the Child is enrolled on a Course.

1.9      “Booking Request Form” refers to the online form used by the Parent to request (“Booking

Request”) that the Child is enrolled on the Course

1.10   “Enrolled’ and “Confirmed-Place” means booked onto a Course

1.11   “Provisional-Place” means a place has been held on a Course for a period of time as stated in the Booking Request Confirmation email.

1.12   “Booking Request Confirmation Email” refers to the email FOOTBELLAS send out shortly after receiving an online Booking Request from the Parent via www.footbellas.com

1.13   “Fee” refers to the cost of the course you have enrolled the Child on.

1.14   “Adult” refers to the person attending the course with the Child.

1.15   “Email” refers to the email address provided by the Parent within the Booking Request Form.

1.16   “Premises” refers to the location where the Course is running.

1.17   “Payment Confirmation Email” refers to the email FOOTBELLAS send to the Parent once payment for a Course has been received in full

1.18   1.6 "After-School Club'' refers to Courses (including online activities) run by FOOTBELLAS at select schools outside of school hours.

2                 ENROLLING A CHILD ON A FOOTBELLAS COURSE

2.1  Each Child's place is allocated on a 'first come, first served' basis. Booking Requests must be accompanied by the appropriate payment within seven (7) calendar days of FOOTBELLAS sending the Booking Request Confirmation Email to the Parent.

2.2  Within the Booking Request Confirmation Email, FOOTBELLAS will confirm if a Provisional-Place has been secured on the Course for the Child. If the Child has secured a Provisional-place on the Course, FOOTBELLAS will also include the payment details within said email.

2.3  If payment hasn’t been received in full within said 7 days, FOOTBELLAS will release the Child’s Provisional-Place and make it available to other Pupils.

2.4  Once payment has been received in full within said 7 days, FOOTBELLAS will send a Payment Confirmation Email to the Parent.

2.5  If FOOTBELLAS is unable to accept the Child due to capacity reasons, the Child may, at the Parent's discretion, be placed on a waiting list.

2.6  From the date the Course is paid, you have a fourteen (14) calendar day cancellation period ("Cancellation Period") to change your mind and cancel the Child’s place on the FOOTBELLAS Course(s), subject to clauses 2.8 and 2.9 below.

2.7  After the Cancellation Period expires, the fee is non-refundable and will be retained by

FOOTBELLAS.

2.8  If the start date of a FOOTBELLAS course falls within the Cancellation Period and the

FOOTBELLAS course has finished before the Parent notifies FOOTBELLAS of their desire to cancel, then the Fee is not cancellable or refundable.

2.9  If the start date of the FOOTBELLAS course falls within the Cancellation Period and some of the

Sessions of the FOOTBELLAS Course has been delivered before the Parent, within the Cancellation Period, notifies FOOTBELLAS of their desire to cancel, then the Fee may be partly refunded in proportion to the number of Sessions delivered.

2.10         Times, dates, fees and details relevant to the Booking Request made by the Parent will be confirmed in the Booking Request Confirmation Email and Payment Confirmation Email.

3                 COURSES

3.1  If a Course session falls on a bank holiday then a replacement session will be offered.

4                 USE OF PERSONAL INFORMATION

4.1  The personal data (as it is defined in the Data Protection Act 2018) of a Child and/or Parent will be processed by FOOTBELLAS, in accordance with its Privacy Policy, which can be found here.

4.2  FOOTBELLAS owns all the rights, title and interest in and to its websites, including software, text and media and its trade marks, logos and brand elements. Nothing within these Terms & Conditions affects or licences the ownership of these rights. Any intellectual property created during any Course or Holiday Camp is owned by FOOTBELLAS.

5                 HEALTH AND SAFETY

5.1  Children participate at their own risk and are obliged to inform FOOTBELLAS and its coaches of any existing injuries or medical condition. All Booking Request Forms must have any known medical conditions stated and any changes to such information must be notified immediately by the Parent to

FOOTBELLAS at FOOTBELLAS@gmail.com.

5.2  If you are unsure whether a Child should participate in a Course please consult the Child’s GP before enrolling the Child on a FOOTBELLAS Course.

5.3  Any medication left on the premises must be clearly labelled and the Child should, unless FOOTBELLAS has agreed by email otherwise, be able to administer it themselves.

5.4  Children must wear suitable footwear and clothing at all times, including FOOTBELLAS t-shirts for all MINIBELLAS Courses.

5.6           If a Child is unwell or has an accident requiring emergency treatment, the Parent will be contacted via the Emergency Contact details provided by the Parent on the Booking Request Form. This number must always be contactable whilst the Child is attending a FOOTBELLAS Course.

5.7           Parents are solely responsible for ensuring that the Emergency Contact details on FOOTBELLAS records are up to date. Parents must advise FOOTBELLAS at FOOTBELLAS@gmail.com if details need to be updated.

6                 PERSONAL PROPERTY

6.1  Children are obliged to take care of their own belongings. FOOTBELLAS can accept no liability for lost or damaged belongings.

7                 LIABILITY

7.1  You acknowledge that the maximum aggregate liability of FOOTBELLAS to a Pupil or Parent/Adult under these Terms & Conditions shall not exceed the FOOTBELLAS Course fee to which a claim relates.

7.2  The liability of FOOTBELLAS and that of its Coaches is restricted to Session time only and then only to gross negligence.

8                 GENERAL

8.1  FOOTBELLAS may, at its own discretion, refuse a Child entry to a FOOTBELLAS Course or

Session of a FOOTBELLAS Course if it is felt that the Child's behaviour is unacceptable

8.2  FOOTBELLAS reserves the right to make changes to the timetable, the Coaches,  the advertised Course or the Course delivery mechanism (for clarity this may mean that we switch to online zoom Sessions) in the event of illness or other circumstances beyond our control.

8.3  Where a Session of a FOOTBELLAS Course has to be cancelled by FOOTBELLAS,

FOOTBELLAS will give as much notice as possible. In the event of a last minute Session cancellation, you will be notified by email, text message, a call to your mobile phone or through a designated FOOTBELLAS social media site. Parents must ensure that they provide FOOTBELLAS with up-to-date contact details.

8.4  In the event of a FOOTBELLAS Course being cancelled, FOOTBELLAS will provide substitute Sessions where possible either at an alternative time, venue or online.  If no alternative can be offered, FOOTBELLAS will provide refunds for Sessions that are unable to be fulfilled.

8.5  It is occasionally necessary to change the time and/or venue of a FOOTBELLAS Session. This will only be done if absolutely necessary and FOOTBELLAS will do its best to keep Session times, Course delivery mechanisms and/or locations as similar as possible but unfortunately this cannot always be guaranteed.

8.6  In the event that a Child is unable to attend a FOOTBELLAS Session, due to sickness, holiday or a decision by the Parent or Child not to attend, FOOTBELLAS regrets that it is unable to refund any payment.

8.7  All Children attending a MINIBELLAS Course must be accompanied at the Sessions by their Parent, who must remain on the premises during the Session and will be wholly responsible for the Child.

8.7 All Children attending a FOOTBELLAS After-School Club must be collected on time after a

Session. FOOTBELLAS is unable to supervise Children after a Session and consistent late collection will result in additional charges.

8.8 Children attending a FOOTBELLAS Holiday Camp or After-School Club will only be able to leave the Session by the means that have been detailed by the Parent in the Booking Request Form.

8.9 These Terms & Conditions, together with any FOOTBELLAS confirmation emails, constitute the entire agreement between the parties which supersedes and extinguishes all previous agreements, promises, assurances, warranties, representations and understandings between them, whether written or oral, relating to its subject matter.

8.10         In the event that one or more of the provisions of the Agreement are found to be unlawful or otherwise unenforceable, those provisions shall be deemed severed from the remainder of the Agreement.

8.11         The Agreement shall be governed by, and construed in accordance with, the laws of England and Wales and any dispute, proceedings or claim shall fall within the jurisdiction of the English courts.
